Terms of Use, Terms and Conditions, Travel Services Agreement and End User License Agreement
THIS IS AN IMPORTANT AND LEGALLY BINDING DOCUMENT. PLEASE READ THIS DOCUMENT CAREFULLY AND IN ITS ENTIRETY.
The Terms and Conditions and Terms of Use set forth herein govern your access to and use of the website, mobile application(s), kiosks, and other digital platforms (together, the “Site”) owned, operated, licensed or controlled by Royal Island Cruises its subsidiaries, affiliates or joint ventures (“we,” “us,” “our,” or the “Company”). As used herein, the term “Digital Platforms” means websites, mobile application(s), kiosks, and other digital platforms.
Supplemental terms of sale and terms of use (the “Supplemental Terms”) may apply to certain events, programs, activities or promotions, and such Supplemental Terms may be disclosed to you separately. Any Supplemental Terms and conditions are in addition to these Terms and, in the event of a conflict, prevail over these terms.
BY CLICKING “I ACCEPT,” DOWNLOADING, INSTALLING, OR OTHERWISE ACCESSING OR USING THE SITE, YOU AGREE THAT YOU HAVE READ AND UNDERSTOOD, AND AGREE TO BE BOUND, BY THE FOLLOWING TERMS AND CONDITIONS AND TERMS OF USE, INCLUDING ALL APPLICABLE LAWS AND REGULATIONS (INCLUDING EXPORT AND RE-EXPORT CONTROL LAWS), AND PRIVACY POLICY (THE “TERMS”). YOUR USE OF THE SITE CONSTITUTES YOUR AGREEMENT TO FOLLOW THESE TERMS AND TO BE BOUND BY THEM. IF YOU DO NOT ACCEPT THESE TERMS, THEN YOU DO NOT HAVE OUR PERMISSION TO USE THE DIGITAL PLATFORMS, DO NOT SUBMIT TRAVELER INFORMATION, OR PURCHASE OR REDEEM ANY TRAVEL PRODUCT THROUGH ROYAL ISLAND CRUISES.
Who We Are
As used in the Terms and on the Site, “Royal Island Cruises, Site, We, Us” refers to Complete Reservation Solutions, LLC (DBA: Royal Island Cruises), with headquarters located at 16192 Coastal Hwy, Lewes, Delaware 19958. If you have any questions about these Terms, the Privacy Notice or the Site, you may contact us via the Customer Service information provided on the Site.
General Terms
These Terms, together with the Privacy Notice and any other agreements expressly incorporated by reference into these Terms, are the entire and exclusive understanding and agreement between you and the Company regarding your use of the Site. You may not assign or transfer these Terms or your rights under these Terms, in whole or in part, by operation of law or otherwise, without our prior written consent. We may assign these Terms at any time without notice or consent.
The failure to require performance of any provision will not affect our right to require performance at any other time after that, nor will a waiver by us of any breach or default of these Terms, or any provision of these Terms, be a waiver of any subsequent breach or default or a waiver of the provision itself. The use of section headers in these Terms is for convenience only and will not have any impact on the interpretation of any provision. Throughout these Terms the use of the word “including” means “including but not limited to”.
If any part of these Terms is held to be invalid or unenforceable, the unenforceable part will be given effect to the greatest extent possible, and the remaining parts will remain in full force and effect.
Role as Travel Advisor / Customer Authorization
By purchasing, accepting, redeeming, or requesting travel services through Royal Island Cruises, you expressly authorize Royal Island Cruises to act as your travel advisor and booking agent for the purpose of researching, selecting, reserving, purchasing, managing, modifying, or confirming travel services on your behalf.
This may include, but is not limited to:

Hotels and resorts
-
Vacation packages
-
Transportation
-
Promotional travel offers
-
Taxes, fees, upgrades, and optional add-ons

Supplier reservations and confirmations
You authorize Royal Island Cruises to use the traveler information you provide to complete reservations and related transactions on your behalf.
You acknowledge and agree that you are responsible for providing complete and accurate traveler information, including legal names, dates of birth, contact information, travel dates, and any required documentation. Errors, omissions, or mismatched information may result in fees, denied boarding, cancellation, or loss of travel without refund.
Third-Party Suppliers
Royal Island Cruises acts as an independent intermediary between you and third-party travel suppliers.
Third-party suppliers may include, but are not limited to:

Cruise lines

Hotels
-
Resorts
-
Airlines
-
Ground transportation providers
-
Tour operators
-
Travel technology platforms

Destination service providers
We do not own, control, manage, or operate these third-party suppliers.
All travel services are subject to the terms, conditions, rules, restrictions, cancellation policies, ticket contracts, passenger agreements, and availability of the applicable supplier.
Royal Island Cruises is not responsible for supplier actions, omissions, pricing changes, delays, cancellations, denied boarding, schedule changes, service failures, overbooking, closures, strikes, weather, mechanical issues, government action, pandemics, force majeure events, or any other event outside our direct control.
Pricing, Service Fees & Package Structure
All pricing provided by Royal Island Cruises may be structured in one or more of the following ways, depending on the specific travel product, promotion, package, or supplier arrangement:

Bundled Package Pricing: A total package price that may include travel components, service fees, fulfillment, customer support, administrative services, promotional incentives, negotiated rates, or subsidized components.

Supplier Direct Pricing: In certain cases, pricing may reflect the same base rate offered by the travel supplier, and Royal Island Cruises may receive compensation through commissions or supplier-paid incentives.

Hybrid Pricing: A combination of supplier pricing, service fees, administrative fees, promotional pricing, negotiated rates, or commission-based compensation.
You acknowledge and agree that Royal Island Cruises is not required to disclose its internal costs, supplier-paid commissions, negotiated rates, wholesale rates, service fees, margins, or compensation structure.
Unless expressly stated in writing, you are purchasing travel services as a complete transaction and not under a cost-plus, pass-through, or price-matching arrangement.
Supplier confirmations, cruise documents, hotel confirmations, invoices, or receipts may show supplier rates, net rates, wholesale rates, taxes, fees, or pricing that differs from the total amount paid to Royal Island Cruises.
You agree that such differences do not constitute overcharging, misrepresentation, fraud, or grounds for refund, cancellation, dispute, or chargeback.
You further agree that the total price paid to Royal Island Cruises represents the agreed-upon price for the travel product, package, promotion, or services arranged, regardless of how individual components may be priced internally or by suppliers.
Royal Island Cruises does not operate as a fiduciary, price-matching service, or lowest-price guarantor.
Promotional Offers, Incentive Travel & Complimentary Travel
Royal Island Cruises may offer promotional, discounted, subsidized, or incentive-based travel offers from time to time.
These offers may include complimentary, reduced-cost, or specially priced travel components. Such offers may be subject to restrictions, including:

Blackout dates

Capacity controls
-
Advance notice requirements

Supplier approval
-
Seasonal restrictions

Taxes and fees
-
Port charges
-
Government fees

Upgrade charges

Administrative or service fees

Redemption deadlines
Unless expressly stated in writing, promotional offers do not include every possible travel cost.
You may be responsible for taxes, fees, port charges, resort fees, gratuities, deposits, upgrades, changes, transportation, insurance, documentation costs, or other incidental expenses.
Promotional travel is not guaranteed until confirmed by the applicable supplier and finalized by Royal Island Cruises.
Submitting preferred travel dates does not guarantee availability or confirmation.
Booking Process and Traveler Responsibility
A booking is not considered final until reviewed, accepted, and confirmed by Royal Island Cruises and/or the applicable supplier.
You are responsible for reviewing all documents, confirmations, names, dates, destinations, cabin types, hotel details, and travel requirements.
If you notice an error, you must notify Royal Island Cruises immediately.
Failure to review documents or promptly report errors may result in additional fees, cancellation, denied boarding, or loss of travel.
Royal Island Cruises is not responsible for errors caused by incorrect information submitted by you, your representative, or any traveler in your party.
Payments
By submitting payment information, you represent and warrant that:

You are authorized to use the payment method provided.

The billing information you provide is accurate.

You authorize Royal Island Cruises to charge the payment method for the agreed amount.

You understand the purchase may include travel services, fees, taxes, package costs, upgrades, or other agreed charges.
Royal Island Cruises may cancel, refuse, or delay processing any transaction if fraud, payment issues, inaccurate information, supplier availability issues, or pricing errors are suspected.
Chargebacks and Payment Disputes
You agree to contact Royal Island Cruises first and allow a reasonable opportunity to resolve any billing concern, service issue, or travel dispute before initiating a chargeback or payment dispute.
Filing a chargeback without first attempting to resolve the issue directly with Royal Island Cruises may be considered a breach of these Terms.
If you initiate an improper chargeback or payment dispute, Royal Island Cruises reserves the right to:

Provide these Terms and all supporting documentation to the payment processor

Cancel pending or future travel services

Deny further services

Recover administrative costs, collection costs, legal fees, and other damages permitted by law
A supplier rate, wholesale rate, net rate, commission, or pricing difference shown on third-party documents is not a valid basis for a chargeback or refund.
Cancellations, Changes and Refunds
All cancellations, changes, refunds, credits, and penalties are subject to the rules of Royal Island Cruises and the applicable third-party supplier.
Many travel products are non-refundable after any applicable state statutory period once purchased, booked, ticketed, confirmed, or submitted to a supplier.
Changes may be limited or unavailable and may require additional fees.
Refunds, if available, may depend on supplier approval and supplier processing time.
Royal Island Cruises does not guarantee refunds unless expressly stated in writing.
Service fees, administrative fees, promotional fees, fulfillment fees, processing fees, and agency fees may be non-refundable.
If a supplier issues a refund to Royal Island Cruises, Royal Island Cruises will process any customer refund owed after deduction of any applicable fees, penalties, chargebacks, unpaid balances, or amounts permitted under these Terms.
Travel Documents, Identification and Entry Requirements
You are solely responsible for obtaining and carrying all required travel documents, including:

Visas

Birth certificates

Vaccination or health documents

Minor travel documents

Any documents required by cruise lines, airlines, hotels, governments, or destinations
Royal Island Cruises is not responsible if you are denied boarding, entry, check-in, or travel due to missing, expired, inaccurate, or insufficient documentation.
No refund is owed for denied boarding or denied travel caused by failure to meet documentation or travel requirements.
Travel Insurance
Royal Island Cruises strongly recommends that all travelers purchase travel insurance.
Travel insurance may protect against certain losses, including cancellation, interruption, medical emergencies, delays, baggage loss, and supplier issues, depending on the policy.
If you decline travel insurance, you assume responsibility for any loss that insurance may have covered.
Availability, Errors and Changes
Travel availability, pricing, schedules, itineraries, cabins, rooms, taxes, fees, and supplier rules may change without notice.
Royal Island Cruises reserves the right to correct errors, inaccuracies, or omissions at any time, including after a customer submits information or payment.
We are not responsible for typographical errors, system errors, pricing errors, supplier errors, or outdated information.
If a material error affects your purchase, we may cancel, revise, or offer available alternatives, subject to applicable law.
Website and Digital Platform Use
You may use our website and digital platforms only for lawful personal use.
You may not:

You agree to indemnify, defend, and hold harmless Royal Island Cruises and its owners, officers, employees, contractors, affiliates, representatives, and agents from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorney’s fees, arising out of:

Governing Law
These Terms and any dispute arising from or relating to Royal Island Cruises, the website, services, travel purchases, promotions, or transactions shall be governed by the laws of the State of Delaware, without regard to conflict of law principles.
Dispute Resolution, Arbitration and Class Action Waiver
You and Royal Island Cruises agree that any dispute, claim, or controversy arising out of or relating to these Terms, our services, our website, any travel transaction, or any relationship between you and Royal Island Cruises shall be resolved by final and binding arbitration, except where prohibited by law.
The arbitration shall be administered by the American Arbitration Association under its applicable consumer arbitration rules.
The arbitration shall take place in Lewes County, Delaware, unless otherwise required by applicable law.
You and Royal Island Cruises waive the right to a jury trial.
You and Royal Island Cruises also agree that claims may only be brought on an individual basis and not as a plaintiff, class member, or representative in any class action, collective action, private attorney general action, or representative proceeding.
The arbitrator may award relief only on an individual basis.
This arbitration provision shall survive termination of your relationship with Royal Island Cruises.
Limitation on Time to File Claims
To the fullest extent permitted by law, any claim or cause of action arising out of or relating to these Terms, the website, services, travel purchase, promotion, or transaction must be filed within one year after the claim arises.
If not filed within one year, the claim is permanently barred.
Severability
If any provision of these Terms is found invalid, unlawful, or unenforceable, that provision shall be enforced to the maximum extent permitted by law or severed if necessary.
The remaining provisions shall remain in full force and effect.
No Waiver
Failure by Royal Island Cruises to enforce any provision of these Terms shall not be considered a waiver of our right to enforce that provision later.
Assignment
